Program Description

The presentation will review concerns that might be addressed by U.S. companies engaged in trade relationships with Canada in the volatile environment of today's political-economic climate. Topics will include heightened protection by Canada through its trade remedy laws, and the ways to optimize "doing business in Canada". The presentation will also focus on the ever-changing political trade relationship between the United States and Canada, the USMCA and other free trade agreements, and averting the global trade war between the US and China that companies may benefit from through Canadian supply chains. The presentation will also touch on the evolving field of sanctions and anti-corruption compliance, and programs needed to properly navigate these potential minefields by Canadian enterprises doing business abroad.

Darrel Pearson, Partner, Bennett Jones, LLP

Darrel Pearson

Darrel is head of the firm's international trade and investment practice. He practices all aspects of international trade and customs law, including trade remedies, customs, international trade treaty matters, export regulation, sanctions and controls, goods and services taxes, government procurement dispute settlement, and other regulatory matters concerning Canadian trade regulation. Darrel has represented Canadian and international clients in more than 200 trade remedy matters involving goods exported to Canada from all over the world and has led some of the most important customs and trade remedy cases heard by Canadian Tribunals and Courts, including two cases heard by the Supreme Court of Canada.

Darrel represents clients across a range of commercial, industrial, primary industry, consumer, agricultural and agri-food industries. He assists these clients on the range of tariff and non-tariff barriers to trade faced by importers and foreign exporters. He develops and implements client cross border trade strategies, represents their interests in internal and external audits, and provides compliance advice. Darrel contributes to the customs component of the firm's uniform approach to tax and customs Transfer Pricing practices and issues. Darrel also represents clients in dispute resolution proceedings relating to government procurement.

Complementing his international trade and investment practice, Darrel is a qualified arbitrator of international commercial and investment treaty disputes. He is member of the International Roster of Neutrals of the International Centre for Dispute Resolution (ICDR) (International division of the American Bar Association), the London Court of International Trade (LCIA) and has been appointed to the NAFTA Ch. 19 Dispute Resolution Panel.

Darrel is internationally recognized as a leading international trade practitioner in multiple independent legal directories, and is consistently ranked Band 1 in Chambers Global and The Legal 500. He has authored numerous publications and frequently speaks on Canadian international trade law issues in Canada and abroad.

Jeff Fraser, Director, Western Region, Canada, Livingston International

As Director, Jeff Fraser leads a dedicated team of consultants in western Canada, focused on helping companies minimize risk and achieve higher levels of customs compliance in their international trade activities. He is based in Edmonton, Alberta.

Jeff has over 27 years of experience in customs brokerage and trade compliance as well as in client service. He joined Livingston in 1992 as an import analyst. Over the next 10 years, Jeff moved into progressively more senior roles at the branch level and client service centres. Before joining Livingston’s Global Trade Consulting Canadian group in 2011, Jeff was regional manager, client service for Canada’s western region for eight years.

Jeff is experienced in tariff classification, international trade agreement compliance, customs valuation, appeals and dispute settlement, refunds, duty drawbacks, sales and excise taxes, seizure appeals, entry audits and anti-dumping legislation as well as international logistics and supply chain management.

He develops customized compliance programs for importers and provides expert guidance on identifying duty savings and recovery programs. He also has considerable experience building crossborder processes specific to the needs of U.S.-based non-resident importers. An experienced speaker, Jeff is a frequent presenter at seminars on customs requirements and related topics, such as duty recovery, GST/HST for non-resident importers and trade compliance optimization.

Jeff holds a professional designation from the Canada Border Services Agency, and is a certified trade compliance specialist as well as a certified customs specialist in both Canada and the U.S. He also holds a professional logistician designation from the Canadian Professional Logistics Institute. Jeff is an alumnus of the University of Victoria, with a bachelor of arts in political science and history. He has delivered numerous seminars on a wide variety of trade and compliance-related topics.
