Program Description:

This program will discuss the cascading effect of the Trade Wars. Do the current discussions on trade wars have you scratching your head and wondering how does this affect your supply chain? This seminar will help you understand how current economic affairs may affect your business. The speakers will provide first-hand information based on their experience counseling clients. You will have the opportunity to ask in depth questions and get answers to help your decision-making process.

1. Section 301, Section 232 and the Growth of the Shadow Tariff Schedule

The imposition of Section 301 tariffs on Chinese goods and Section 232 tariffs on steel and aluminum goods has sent importers scurrying to the once little used Chapter 99 of the Tariff Schedule to determine which tariffs apply to their products. At the same time, the creation of hundreds of exclusions to these tariffs, most of which are codified in Chapter 99, have created a "shadow" tariff schedule, often featuring terms not defined anywhere in the Harmonized System. How are these Chapter 99 tariff provisions applied? How should they be interpreted? Will Customs issue classification rulings interpreting them? Will these rulings have any force or influence when Section 301 and 232 tariffs go away? And are there possible legal challenges to the imposition of these tariffs in the first place? Can importers use the Section 321 "small value shipment" exclusion to avoid these tariffs? Can they use duty drawback?

2. "Please, Sir, may I have Another?" [apologies to "Oliver!"]

The art, science and witchcraft of the Section 301 and Section 232 tariff exclusion processes, and hurdles importers face when seeking to extend their exclusions, take advantage of an exclusion issued to someone else, or correct a competitive imbalance caused by an exclusion.

3. Tariffs On, Tariffs Off -- New Trade Agreements

NAFTA will shortly be replaced by the new United States-Canada-Mexico Agreement (USMCA).. How are the agreements similar, how are they different, and what do international traders need to know about origin rules, certification procedures and other operational issues? In addition, a quick overview of the United States-Japan Agreement, which entered into force on January 1, 2020 will be provided.
